Abstract
Denne masteroppgåva handlar om kva forliksråda si kompetanse kan bety for rettstryggleiken der. Forliksråda sin kompetanse er både den kompetansen som forliksråda har med heimel i lov og den kompetansen som medlemane har. Fleirtalet av medlemane i forliksråda er lekfolk. Det er grunn til å setja spørjeteikn ved om det vert teke nok omsyn rettstryggleiken når lekfolka skal bruka loven. Oppgåva er delt inn tre delar. Det er meir enn to hundre år siden forliksråda vart oppretta r. I den første delen skriv eg om forliksråda si historie og om tvistemålsloven som var den prosessloven som gjaldt for forliksråda før tvisteloven kom. I den andre delen skriv eg om forliksråda i dag og korleis dei løyser oppgåva som førsteinstans i sivilprosessen. I denne delen skriv eg også om den nye tvisteloven og kva den har å seia for behandlinga i forliksråda. I tredje, og siste del, vurderar eg forliksråda og kjem med forslag til tiltak som kan auka rettstryggleiken i forliksråda.
This thesis is about what the settlement councils their expertise can mean for the security there.
