Some conceive the war on terror as a new paradigm within international relations. As the nature of this war is essentially different from other wars the traditional just war theory might not be that applicable. Asa Kasher and Amos Yadlin have recently published a doctrine for fighting terror in which they reject one of the pillars within traditional just war theory, namely the combatant-noncomatant distinction. This paper examines the moral legitimacy of rejecting this distinction.
