Reelt ureturnerbare asylsøkeres rett til arbeid

Abstract

Avhandlingens tema er reelt ureturnerbare asylsøkeres rett til arbeid og tar sikte på å undersøke om deres aksepterte opphold uten rettigheter står i et proporsjonalt forhold til Norges folkerettslige og konstitusjonelle forpliktelser om individers rett til arbeid. Gjennom en analyse av statens forpliktelser til å respektere, sikre og beskytte retten til arbeid, er avhandlingens hensikt å undersøke om det menneskerettslige rammeverket innebærer konkrete og håndhevbare rettigheter for reelt ureturnerbare som staten ikke uten videre kan velge å oppfylle.

The topic of the dissertation is in fact the right of non-returnable asylum seekers to work and aims to investigate whether their accepted stay without rights is in a proportional relation to Norway's international law agreements and constitutional obligations regarding individuals' right to work. Through an analysis of the state's obligations to respect, secure and protect the right to work, the purpose of the dissertation is to investigate whether the human rights framework entails concrete and enforceable rights for non-returnable asylum seekers that the state can not easily choose to fulfill.
