Abstract

Siden grunnlovsreformen i 2014 har vi hatt et selvstendig diskrimineringsforbud i Grunnloven. Avhandlingen analyserer vernet i Grunnloven § 98, sett opp mot vernet i EMK artikkel 14, tilleggsprotokoll 12 artikkel 1 til EMK og ordinær lovgivning. Avhandlingen vurderer hvilke diskrimineringsgrunnlag som omfattes av vernet, samt vernets anvendelsesområde og rekkevidde.

After the adoption of a human rights catalog in 2014, we have an independent prohibition of discrimination in the Constitution. The thesis analyzes the protection guaranteed in the Constitution in light of the protection under the ECHR Article 14, Protocol 12 article 1 to the ECHR and national legislation in the field of discrimination. The thesis seeks to assess the grounds of discrimination covered and the scope of the guarantee against discrimination.
