Abstract
Oppgaven gir en framstilling av gjeldende rett for samværsrett for andre enn foreldre etter omsorgsovertakelse. Oppgaven tar for seg nasjonale og internasjonale rettsregler og prinsipper rundt spørsmålet, samt ser på behandlingen av samværskrav fra denne gruppen. Det stilles spørsmål ved om rettighetene for såkalte «betydningsfulle andre» burde vært sterkere, og antydes at barnevernloven § 4-19 tredje og fjerde ledd muligens strider mot EMK.
This thesis outlines regulations regarding visitation rights for people other than parents when children are taken into public care. The thesis considers national and international regulations and principles concerning the issue. It also looks at the way visitation rights are considered and processed. The thesis questions whether Norwegian national rights for so-called meaningful others are strong enough, and suggests that they may conflict with The European Convention on Human Rights (ECHR).
