dc.description.abstract | Når en gravid kvinne ikke ønsker et keisersnitt anbefalt av helsepersonell av hensyn til barnet, oppstår det en konflikt. Kvinnens rett til selvbestemmelse kommer i opposisjon til fosterets rett til liv. Samtidig kommer helsepersonell i en svært vanskelig situasjon da deres plikt til å hjelpe fosteret kommer i konflikt med deres plikt til å la kvinnen bestemme over sin egen kropp.
Denne type problemstillinger er sjeldne, men kommer ofte uventet, og er særdeles utfordrende medmenneskelig, etisk og juridisk.
I oppgaven blir det lagt vekt på en diskusjon rundt etiske verdier som den gravide kvinnens rett til autonomi, hennes beslutningskompetanse og vurdering av denne, barnets rett til å leve, samt hensyn til helsepersonells ikke – skade – prinsipp. Oppgaven gir åpenbart ikke noe svar på disse vanskelige dilemmaene. De må løses i hver enkelt situasjon, men oppgaven setter søkelys på vurderinger, verdier og juridiske retningslinjer som kan være til hjelp for klinikere som plutselig kan finne seg selv stående i en av disse vanskelige og utfordrende situasjonene. | nor |
dc.description.abstract | In rare cases, a pregnant woman refuses to undergo a Caesarean section recommended by her obstetrician in order to save the life or the future health of the fetus. In these cases, a conflict will arise between the woman’s Right to Autonomy and the fetus´ Right to Life. According to the Law of Patient Rights in Norway, a mentally competent adult patient has the right to refuse any form of treatment, even life-saving treatment. However, does this also apply to pregnant women? Does she hold the right to refuse treatment on behalf of her fetus? And does the fetus hold any legal or moral rights on its own?
At the same time, the obstetrician, and other health professionals involved, will find themselves in a very difficult ethical dilemma. Are they both ethically and legally bound to respect the woman’s wishes? Or do they have a right to intervene without her consent, in order to protect the fetus, and their own ethical integrity?
The paper discusses both the ethical and judicial aspects of the conflict with special focus on the pregnant woman’s competence and right to autonomy. The legal and moral rights of the fetus are explored. Furthermore, health personnel’s rights and obligations to the pregnant woman and the fetus are discussed in light of the Hippocratic principle of "do no harm".
