Ikke bare svart og hvitt : når politi og sykepleier skal samarbeide på en legevakt

Abstract

Formål: Å belyse utfordringer rundt ivaretakelse av taushetsplikt, og samarbeid mellom sykepleier og politi på en legevakt.

Teoretisk forankring: Det benyttes teori fra fagområdene juss, etikk og samarbeid. Leseren gis et innblikk i de to gruppenes lovverk rundt taushetsplikten, samt bruk av skjønn i etiske vanskelige situasjoner. Vangen og Huxhams (2009) samarbeidsmodell presenteres og benyttes i oppgavens diskusjonsdel.

Metode: Studien er utforskende og det ble benyttet semistrukturerte dybdeintervju i datainnsamlingen. 5 polititjenestemenn og 5 sykepleier ble intervjuet. Utvalgskriteriene vektla å skaffe deltakere med relevant erfaring, og samtidig med variasjon i forhold til ansenitet. Prinsipper fra Malteruds (2003) systematiske tekstkondensering er benyttet i analysen av data.

Resultater: Politiet opplever store individuelle forskjeller i hvordan sykepleiere tolker og praktiserer taushetsplikten. Funnene tyder videre på at politiet anser taushetsplikt mellom etater som mindre viktig. Politiet søker å oppnå en dialog, og er opptatt av ulike kommunikasjonstekniker i møtet med sykepleier. Sykepleierne opplever ofte usikkerhet på lovverket rundt taushetsplikten, og i møtet med politiet. Sykepleierne opplever at mangel på kontroll over hvor politiet oppholder seg, kombinert med svært åpne lokaler gjør det utfordrende å overholde taushetsplikten. Funnene indikerer at interaksjonen mellom gruppene er en kompleks prosess hvor mange ulike faktorer påvirker graden av informasjon som utveksles. Sykepleierne ønsker økt forståelse for sin rolle, og aksept for taushetsplikten.

Konklusjon: Ulike profesjonskultur og målsetninger, samt fysisk utforming på lokalene skaper utfordringer i samarbeidet mellom politi og sykepleier på en legevakt. Ivaretagelse av taushetsplikten ovenfor politi er en komplisert prosess og det er individuelle forskjeller i praktiseringen. Det etterlyses fra begge grupper utvidet dokumentasjon samt retningslinjer som klarere vil definere samarbeidet.

Purpose: To highlight challenges of maintaining professional secrecy, and cooperation between nurses and police at an emergency ward.

Literature review: Theory and research within law, ethics and cooperation has been applied. The regulations governing the professional secrecy for the two groups are described. A theoretical consideration of the ethical choices and discretionary judgment the groups are faced with has been performed. From research on cooperation, Vangen and Huxhams (2009) model has been described, and in combination with the relevant theory, been used to interpret the study's findings.

Method: The study aims to explore the experiences of police and nurses, and a semi-structured in depthinterview has been used as a data collection method. 5 police officers and 5 nurses have been interviewed. In the selection process one has aimed to find participants with direct experience with the topic, but with a variation of seniority. The interviews were analyzed using principles from Malterud's systematic text condensing.

Results: The findings show that the police are experiencing individual differences in how nurses interpret and practice the professional secrecy. They also focus on their communication, and frequently aim to obtain dialogue with the nurses. The police regard the professional secrecy between public services as of minor importance. The findings from the nurses indicate that they often experience insecurity about the professional secrecy regulations and in the interaction with the police. They express lack of control on where the police is located, which in combination with an open surrounding at the emergency ward, is complicating the process of maintaining the professional secrecy. Significant variations in how the police act on arrival is reported, and this impacts how the cooperation develops. The findings indicate that the interaction between police and nurses is a complex situation where many factors play in and influence the degree of information exchanged. The nurses’ wishes increased understanding from the police with respect to their relation with the patients, and that the police respect their professional secrecy.

Conclusion: Different professional culture and aims, in addition to the physical layout of the emergency ward creates complications in the cooperation between police and nurses. Maintaining the professional secrecy is a complex process and there are individual differences in the application of the regulations. More documentation and guidelines which defines the cooperation between the groups are requested.
