Abstract

Hovedoppgaven omhandler den norske reguleringen av reklame for livssyn og politiske budskap i kringkasting. Slike ytringer har i lengre tid vært forbeholdt trykte annonser og kinosaler, mens det i forskrift har eksistert et forbud i fjernsyn og radio. Forbudet var omstridt, særlig på grunn av forholdet til vernet om ytringsfriheten i Grunnloven § 100. 1. juli 1999 ble forbudet i forskrift erstattet av en egen forbudshjemmel i kringkastingsloven. Lovvedtaket innebar en juridisk forankring av forbudet i fjernsyn, samtidig som radioen ble fritatt fra forbudet. Det er lovendringsprosessen, fra høring til lovvedtak, som er undersøkelsens fokus. Oppgaven søker å avdekke hvilke argumenter og interesser som lå bak lovendringen. I et større perspektiv er det en undersøkelse om mediepolitikkens forhold til målet om ytringsfrihet. Forbudet er fortsatt omstridt.

This thesis deals with Norwegian regulation of commercials which promote religious and political views through broadcasted media. Such messages have, for a long period of time, been reserved for printed adverts and cinama theatres. Radio and television have, through regulations, been prohibited from broadcasting commercials of this nature. These regulations have been a controversial issue, particularly due to the concern for the protection of freedom of speech, which is established by section 100 of The Constitution. On July 1st 1999 the regulations were replaced by a prohibition pursuant to The Broadcasting Act. When this bill was passed, the prohibition of political and religious commercials in television was given a legal platform, while radio commercials were exempted from the prohibition. It is the process from the green paper to this legislative amendment, which is the focal piont of this thesis. In a wider perspective the thesis explores the way in which media politics deal with the objective of freedom of speech. The act is still controversial.
