dc.description.abstractIn situations where an applicable norm of IHL and an equally applicable norm of IHRL seem to be in conflict with each other it is often unclear how to solve the apparent norm conflict. The principle of best protection represents a solution where that norm which provides the highest standard of protection should trump the other competing one. This thesis sets out to evaluate whether this principle is viable in practice and concludes that the principle is suitable for non-extraterritorial NIAC situations.eng
