Abstract
Oppgaven tar sikte på å klargjøre hvordan hvit fosfor-våpen er regulert i folkeretten, spesifikt under Kjemivåpenkonvensjonen, Konvensjonen om inhumane våpen (CCW) og folkerettslig sedvane. Det tas utgangspunkt i fem av de mest vanlige bruksmåtene for hvit fosfor i militær sammenheng. Det argumenteres for at den folkerettslige regulering er uklar eller mangelfull og at det er vesentlig uenighet blant folkerettslige eksperter. Avslutningsvis argumenteres det også for at det eksisterer et gap mellom den folkerettslige regulering på den ene siden og den allmenne rettsfølelse på den annen, og det antydes hvordan hvit fosfor-våpen kan bli gjenstand for sterkere regulering i folkeretten.
The aim of this master’s dissertation is to clarify how white phosphorus (WP) weapons are regulated under international law, particularly in regard to the main applications of WP weapons as a means of warfare. It discusses the status of WP weapons and its main applications in general terms in relation to the Chemical Weapons Convention (1993), the Convention on Certain Conventional Weapons (1980) and customary international humanitarian law. It suggests that there is significant disagreement and lack of clarity about the regulation of WP weapons in international law, and that there seems to be a significant gap between the legal regulations and the general opinion about WP weapons among states and in the general public. Finally, it briefly comments on how this gap may be closed through treaty regulation in the future.
